Welcome to TachTab! These Terms of Service ("Terms") govern your access to and use of the TachTab software platform, website, and related services (collectively, the "Service").

Please read these Terms carefully before using TachTab. By registering an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.


1. About Us and How to Contact Us

The Service is owned and operated by Saibernetic OÜ, a private limited company (osaühing) incorporated under the laws of the Republic of Estonia.

2. What TachTab Is (and Is Not)

2.1 A Financial Ledger Tool Only

TachTab is a software-as-a-service (SaaS) financial ledger designed specifically for shared aircraft ownership groups (typically 2 to 6 co-owners). The Service allows groups to:

  • Record flight engine-hour meter readings;
  • Calculate flight costs based on hourly rates set by the group admin;
  • Accrue a per-hour "engine reserve" toward future engine overhaul budgeting;
  • Generate monthly member dues and invoices;
  • Export statements and invoices in PDF and CSV formats; and
  • Facilitate member invoice settlements via integrated card payments.

2.2 NOT an Aviation, Airworthiness, or Maintenance Record

IMPORTANT Critical Aviation Disclaimer: TachTab is strictly a bookkeeping and financial budgeting tool. It is NOT an official pilot logbook, NOT an aircraft technical logbook, NOT a maintenance tracking system, and NOT airworthiness documentation under EASA, FAA, or any national civil aviation authority regulations.

  • No Safety Reliance: Engine-hour figures, accrued engine reserves, and estimated hours-to-overhaul displayed in TachTab are financial calculations based solely on user inputs. They must never be used or relied upon for scheduling aircraft maintenance, determining airworthiness, verifying engine time limits, or making flight safety decisions.
  • Operator Responsibility: The pilot-in-command and the registered aircraft owner/operator retain sole and absolute legal responsibility for inspecting official aircraft logbooks, ensuring proper maintenance compliance, and verifying airworthiness before every flight.

2.3 No Financial, Tax, Accounting, or Legal Advice

TachTab calculates numbers based on inputs provided by your group. Saibernetic OÜ is not a certified public accountant, tax advisor, financial advisor, or law firm. TachTab does not provide accounting, tax, financial, or legal advice. You and your co-ownership group are responsible for verifying your own tax liabilities, accounting practices, and compliance with local laws.


3. How Money Moves (Payment Processing & Funds Disclaimer)

3.1 TachTab Never Holds Customer Funds

IMPORTANT Funds Disclaimer: Saibernetic OÜ (TachTab) never holds, receives, transmits, or takes custody of customer funds at any point. TachTab is not a payment processor, not a money transmitter, not an escrow provider, and not a bank or financial institution.

3.2 Payment Processing via Stripe Connect

  • Direct Charges: TachTab uses Stripe Connect Standard with direct charges. Each aircraft co-ownership group connects its own independent Stripe account to the Service.
  • Merchants of Record: When a member pays an invoice through TachTab, the money moves directly from the member's payment method to that group's connected Stripe account. The aircraft group is the merchant of record for all transactions, and Stripe Payments Europe, Single Member Limited (or its local affiliate) acts as the payment processor.
  • No Touch on Payment Credentials: No payment card numbers, CVVs, or bank account credentials ever touch, pass through, or store on TachTab servers. All sensitive financial credentials live securely with Stripe.

3.3 Refunds and External Payments

  • Refunds: Group administrators may issue refunds to members. Refunds are paid exclusively out of the group's own Stripe account balance. TachTab cannot, and will not, issue refunds on behalf of a group or from TachTab's own funds.
  • Offline Payments: Groups may record payments made outside the platform (such as cash or direct bank transfers). TachTab records these entries purely as informational ledger notes entered by group members.

4. User Roles and Co-Ownership Member Disputes

4.1 Platform Roles

There are three user roles on the Service:

  1. TachTab (Saibernetic OÜ): The operator providing the SaaS infrastructure.
  2. Group Administrator ("Group Admin"): The member who sets up the group profile, configures hourly rates and reserve rules, invites members, connects the group's Stripe account, and issues monthly billing.
  3. Partner / Member: An individual member of an aircraft group who logs flight hours, views statements, and pays their allocated share of expenses.

4.2 Disputes Between Group Members

  • Neutral Record Keeper: TachTab records data as entered by group members. Saibernetic OÜ is not a party to, nor an arbiter, mediator, or guarantor of, any financial debt or dispute between members of an aircraft group.
  • Member Responsibility: Any disagreement regarding flight costs, meter readings, engine reserve allocations, unpaid dues, or co-ownership agreements is strictly between the members of that group. Saibernetic OÜ has no obligation to resolve, enforce, or collect debts between co-owners.

5. Accuracy of Information

TachTab performs automated mathematical calculations based on the numbers, rates, and meter readings entered by users. TachTab does not verify, audit, or cross-check the accuracy of user inputs. You and your group members are solely responsible for ensuring that all logged flight times, fuel receipts, hourly rates, and expense allocations are accurate.


6. Ownership of Customer Data

6.1 You Own Your Data

Saibernetic OÜ claims no ownership rights over any content, flight records, fuel receipts, financial logs, or member data submitted by you or your group to TachTab ("Customer Data"). Your data remains entirely yours.

6.2 License to Service Your Account

You grant Saibernetic OÜ a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Customer Data solely to the extent necessary to provide, maintain, and support the Service for you and your group.


7. Invoices, Credit Memos, and the Audit Log

To ensure financial integrity and compliance with standard accounting practices:

  • Immutable Billed Invoices: Once an invoice is generated and issued to a member, it cannot be edited, rewritten, or deleted within TachTab.
  • Corrections via Credit Memos: If an error occurs on a billed invoice, corrections must be made by issuing a credit memo or an adjusting entry in the ledger.
  • Append-Only Audit Log: TachTab maintains an append-only, tamper-resistant audit log of every action that moves money, alters member debts, or modifies group rates. This audit log cannot be modified or erased by users.

8. Account Termination and Data Retention

8.1 Termination by You

You may stop using TachTab at any time. A Group Admin may close their group account by contacting hello@tachtab.com, provided all outstanding platform subscription fees are paid.

8.2 Termination by TachTab

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay platform subscription fees, or use the Service in a manner that creates legal liability for Saibernetic OÜ.

8.3 Data Deletion vs. Accounting Retention Obligations

  • User Profiles: Upon account closure, personal profile information (such as login credentials) will be deleted or anonymized upon request within 30 days.
  • Financial & Tax Records: In accordance with Estonian statutory accounting laws (Raamatupidamise seadus § 12), financial ledger source documents, issued invoices, credit memos, and transaction audit logs must be retained for seven (7) years from the end of the relevant financial year. Such data cannot be deleted prior to the expiration of this statutory retention period, even if an account is closed or an erasure request is submitted.

9. Service Availability and Changes

9.1 Availability

We strive to keep TachTab available and running smoothly, but we cannot guarantee uninterrupted or error-free operation. We may occasionally perform maintenance, updates, or emergency repairs.

9.2 Modifications to the Service

We may update, modify, or discontinue specific features of the Service from time to time. We will provide reasonable notice for any material changes that significantly reduce core functionality.

9.3 Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via a notice within the platform at least 30 days before the new terms take effect. By continuing to use TachTab after the updated Terms become effective, you agree to be bound by the revised Terms.


10. Liability and Warranty Disclaimer (EU & Estonian Law)

10.1 Service Warranty

TachTab is provided "as is" and "as available". To the maximum extent permitted by mandatory applicable law, Saibernetic OÜ disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Limitation of Liability

  • Statutory Mandatory Exceptions: Nothing in these Terms shall limit or exclude Saibernetic OÜ's liability for:
    1. Intentional breach (tahtlus) or gross negligence (raske hooletus) under Estonian law (Võlaõigusseadus § 104);
    2. Personal injury or death caused by negligence; or
    3. Any other liability that cannot be excluded or limited under mandatory EU or Estonian consumer law.
  • Cap on Indirect and Direct Damages: Subject to Section 10.2(1) above:
    1. Saibernetic OÜ shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits, loss of data, loss of business opportunity, or aircraft grounding costs.
    2. Saibernetic OÜ's total aggregate liability arising out of or relating to the Service or these Terms shall be strictly capped at the total platform subscription fees actually paid by you to Saibernetic OÜ during the twelve (12) months preceding the event giving rise to the claim (or €100 if you have used a free tier).

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of Estonia, without giving effect to any choice of law principles.

11.2 Jurisdiction

Except as provided in Section 11.3 below, the courts of Estonia (with the Harju County Court in Tallinn as the court of first instance) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

11.3 Mandatory EU Consumer Rights

If you are an individual consumer residing in the European Union or European Economic Area (EU/EEA) using TachTab for non-commercial personal purposes, nothing in these Terms deprives you of the protection afforded to you by mandatory provisions of the consumer protection laws of your country of residence, including your right to bring legal proceedings in your local courts or use the European Online Dispute Resolution platform.
